How NMRS Medical Practice processes personal and special category data.
1. Who We Are
NMRS Medical Practice is a specialist psychiatric practice providing independent old age psychiatry and mental capacity assessment reports, based in Alwoodley, Leeds, LS17. For any data protection query, contact admin@nmrs-medical.co.uk.
2. What Personal Data We Process
Depending on the nature of an instruction or enquiry, we may process:
- Contact details of instructing solicitors, firms and other professionals (name, firm, role, email, telephone)
- Contact and identifying details of the person being assessed (name, date of birth, address)
- Special category health data — including medical records, diagnoses, medication and clinical history — where required to prepare an assessment or report
- Information about family members, attorneys, deputies or other relevant parties, where provided as part of an instruction
- Correspondence and documents provided in connection with an instruction
3. Why We Process This Data
We process personal data to respond to enquiries, to accept and carry out formal instructions, to prepare medico-legal reports, to communicate with instructing parties, and to meet our professional, regulatory and legal obligations.
4. Lawful Basis for Processing
We rely on the lawful bases available under UK GDPR and the Data Protection Act 2018, which will typically include performance of a contract (carrying out an instructed assessment), legitimate interests (responding to enquiries and administering the practice), and legal obligation (regulatory and record-keeping requirements). Where we process special category health data, we rely on an applicable condition under Article 9 UK GDPR — most commonly, the provision of health assessment by a medical professional, or explicit consent where appropriate.
5. Special Category Health Data
Medico-legal assessments necessarily involve sensitive health information. This data is handled with particular care, accessed only by those directly involved in preparing or supervising the relevant report, and is not used for any purpose beyond the instructed assessment and associated professional obligations.
6. Who Data May Be Shared With
Personal data may be shared with the instructing solicitor or party, the court where a report is submitted in proceedings, and professional advisers or service providers who support the practice (for example, IT or administrative support), under appropriate confidentiality arrangements. We do not sell personal data or share it for marketing purposes.
7. Data Retention
Personal data is retained for as long as necessary to fulfil the purposes described in this notice, and in line with applicable legal, regulatory and professional record-keeping obligations relevant to medico-legal reporting.
8. Your Rights
Subject to applicable law, you may have the right to request access to, correction of, or erasure of your personal data, to object to or restrict certain processing, and to data portability. To exercise these rights, contact admin@nmrs-medical.co.uk. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk.
